Abstract
AI is a field which has grown enormously in commercial application and social acceptability in recent times. Innovations are increasingly likely to be based on AI. We will look at how such innovations may be protected. In particular, whether patenting AI-based innovations is the right approach and the limits to patent protection for AI.
- Protection for AI might in some instances be obtained through controlling access to training data
- Additional considerations arise in relation to whether to file for patent protection for AI-based inventions
- AI can be patentable subject to certain limitations
Speaker's Biography
Chris is an experienced attorney working in the field of computing and software-based inventions. In particular, Chris has wide experience in handling inventions relating to the subject matter on the edge of patentability. Chris’s software experience lies in the fields of MedTech, including diagnostic methods, instrumentation and control, and computer communication and control. Chris has handled Artificial Intelligence (AI) subject matter before the EPO and has given talks on the subject of AI patentability to both in-house and academic audiences. Chris regularly drafts and prosecutes patent applications in Europe, the US and China amongst other jurisdictions. Furthermore, Chris is also involved in post-grant proceedings, freedom-to-operate exercises and due diligence on IP portfolios.
